Terms and Conditions

1. Definitions

Service Provider: Probust, established in the Netherlands, registered with the Chamber of Commerce under number 97254428.

Client: The company that subscribes to a website provided by the Service Provider.

Service: The provision of a website including hosting, CMS management, and DNS configuration support.

2. Service Provision

The customer receives a functioning website, hosted via Google Cloud (zone: europe-west4), with a reverse proxy hosted by Strato (Germany).

The customer manages the content of their website via a user-friendly CMS.

The Service Provider supports the customer in setting up DNS records to make the website accessible via the customer's domain name.

The customer manages their own domain name and any email services.

3. Ownership and Usage Rights

The customer has the right to use the website provided as long as an active subscription is active.

The source code, the CMS, and the underlying infrastructure remain the property of the Service Provider or its suppliers.

Upon termination of the subscription, the right to use the delivered website expires.

4. Payment and Suspension

The customer pays monthly in advance. Payment must be received no later than the first day of the month.

If payment is not received, the website will be temporarily taken offline.

If no payment is received for three consecutive months, the website will be permanently taken offline and deleted.

Reactivation after temporary offline status will take place once the outstanding amounts have been paid.

5. Termination

The subscription can be canceled monthly by either party, with a notice period of one calendar month.

6. Support and Complaints

Support and complaint handling are handled via an online service desk.

The Service Provider strives to respond to messages within a reasonable timeframe, but does not offer telephone customer service or guaranteed response times.

7. Liability

The Service Provider is not liable for direct or indirect damage resulting from the use of the Service, unless there is intent or gross negligence.

The Service Provider is not responsible for the functioning of third-party domain names or email services.

8. Applicable Law

This agreement is governed by Dutch law.

Disputes will be submitted exclusively to the competent court in Utrecht, unless mandatory law provides otherwise.

9. Data Deletion Instructions

If the customer or an end user requests the deletion of personal data or other data processed by the Service, this can be done by contacting us at info@probuust.nl.

The Service Provider will, within a reasonable period of receiving such a request, delete the relevant data from its own systems and, where possible, from linked external systems (such as social media or API links, including Facebook).

In cases where the Service Provider is obliged to retain data based on legal provisions or court orders, deletion will only take place once these obligations expire.
